DOCUMENTS FOR PURCHASE A PROPERTY IN BRAZIL

A) PROPERTY DOCUMENTS


1. Registration date of the property, the location of the property, who is real owner of the property, the property is not mortgaged, sold, etc.. You should request the certificate, which will include a history of the property in the last 20 (twenty) years. 

2. Negative Certification of Debt with City Hall, where you can check the status of the property on IPTU (Urban Territorial Tax), which could be obtained at: http://www.sefin.fortaleza.ce.gov.br . 

3. For building, the Negative Certificate of Debt in condominium, this could be issued by the liquidator or administrator of the condominium. 

4. Discharge of Electricity, which could be issued by the national supplier. 

5. In the case of houses, will require the discharge of water accounts, which could be issued by the national supplier. 

6. In the case of property in area of sea (in the registration documents) will be necessary to discharge rates “laudêmio”.

B) THE SELLER(S) DOCUMENT(S) 

1. Certified copy(s) of the CPF and the identity ballot. 

2. If married, the certified copy of the Marriage Certificate. 

3. Negative certificate of State Debts that could be obtained at: www.sefaz.ce.gov.br. (For married will also need a copy of the spouse) 

4. Joint Certificate of Negative Debt Federal Debt and Active Union that could be obtained at: www.receita.fazenda.gov.br. (For married will also need a copy of the spouse) 

5. If the seller is a physical person, will be legally required Negative Certificate of Debts with the INSS which could be obtained at: www.receita.fazenda.gov.br. 

C) THE BUYER(S) DOCUMENT(S)  

1. Certified copy(s) of the CPF and the Identity ballot. (In a case of multiple buyers, is required for all) 

2. If married, certified copy of the Marriage Certificate is required. 

3. Negative certificate of State Debts that could be obtained at: www.sefaz.ce.gov.br. (For married will also need a copy of the spouse) 

4. Joint Certificate of Negative Federal Debts and Active Union that could be obtained at: www.receita.fazenda.gov.br. (For married will also need a copy of the spouse) 

5. If the seller is a physical person, will also be legally required Negative Certificate of Debts with the INSS which may be obtained at: www.receita.fazenda.gov.br. 

III.I - Documents required for a FOREIGNER OBTAIN A PROPERTY IN FORTALEZA. 

► A certified copy of passport of alien or RNE (National Registration of Foreigner); 
► A certified copy of the CPF – “Cadastro de Pessoa Física”, Ministry of Finance. 

Note: To gain entry in the CPF, they must go to any distribution of federal revenue in major Brazilian cities with passport and visa to enter Brazil, seeking its registration after completion of the Individual Cadastral Data. 
The register in the CPF can be done by a public office with specific powers which could be the Brazilian consulate, for instance. In this case, beyond the completion of the Cadastral Data of Individual, it is necessary to copy the names used in the country of residence abroad, beyond the identity of the prosecutor and attorney. 

For aliens who reside abroad will need: 

► Passport of the alien or RNE (National Registration of Foreigner); 
► Birth Certificate with Portuguese sworn translation and authenticated by the Brazilian consulate in the country of origin from abroad; 
► The CPF can be applied directly in the Brazilian Consulate, and if the buyer(s) is married, the CPF will be required for the spouse; 
► Attorney in the consulate, with full powers granted to the person you trust to buy the property, sign and resolve any issue before the Notary Public, Federal Record of Buildings and Revenue for the regularization of property acquired on behalf of the alien. 

III.II - CONSIDERATIONS ON THE PURCHASING OF PROPERTY BY FOREIGNERS. 

Any citizen may acquire property in urban Brazil, including foreigners. The only restriction is the purchase of existing rural buildings or land located in the range of 100 meters along the Brazilian coast. This restriction does not apply in the case of autonomous units of condominiums, the purchase of apartments in building located in the marine field. 

The Constitution of Brazil states that the law regulates and limits the acquisition of rural property by foreigners, not applying to the acquisition of city property. Emphasized that the purchase of real estate in Brazil does not give the alien the right to obtain visa of any kind. 

The foreigner can not buy newspaper companies, broadcasting images and sound - only Brazilian born or naturalized for more than ten (10) years - or legal person constituted under Brazilian law that have headquarters in the country. These companies must have at least 70% (seventy percent) of capital in the hands of Brazilians born or naturalized, who must hold the direction of the company and responsibility for the selection of the programming provided and regulated by the government.
